Bu Kullanım Koşulları ("Koşullar"), By Shiva Dış Ticaret tarafından sunulan Digimoli Pro Sales hizmetinin ("Hizmet") kullanımını düzenler. Hizmete kaydolarak veya Hizmeti kullanarak bu Koşulları kabul etmiş sayılırsınız.

1. Hizmetin Tanımı

Digimoli Pro Sales; Meta (Instagram & Facebook) ve diğer desteklenen platformlardan gelen mesaj ve yorumları yapay zeka ile yanıtlayan, müşteri bilgisi toplayan ve entegre e-ticaret sistemleri üzerinden sipariş/ödeme süreçlerini yürüten bulut tabanlı bir yazılım hizmetidir (SaaS).

2. Uygunluk ve Hesap

  • Hizmeti kullanmak için en az 18 yaşında olmanız ve işletmeniz adına sözleşme yapmaya yetkili olmanız gerekir.
  • Hesap bilgilerinizin gizliliğinden ve hesabınız altında gerçekleşen tüm faaliyetlerden siz sorumlusunuz.
  • Sağladığınız bilgilerin doğru ve güncel olduğunu kabul edersiniz.

3. Kabul Edilebilir Kullanım

Hizmeti kullanırken aşağıdakileri yapmamayı kabul edersiniz:

  • Yürürlükteki yasaları, Meta Platform Politikalarını veya üçüncü taraf platform kurallarını ihlal etmek,
  • Spam, yanıltıcı, dolandırıcılık amaçlı veya istenmeyen mesajlar göndermek,
  • Yasa dışı, zararlı veya yasaklı ürün/hizmet pazarlamak,
  • Hizmeti tersine mühendislik yapmak, kötüye kullanmak veya güvenliğini tehlikeye atmak,
  • Üçüncü kişilerin verilerini onlarına bilgisi/rızası dışında işlemek.

4. Üçüncü Taraf Platformlar

Hizmet, Meta ve Shopify gibi üçüncü taraf platformların API'lerine bağlıdır. Bu platformların kullanım şartlarına uymak sizin sorumluluğunuzdadır. Bu platformların kendi politikalarındaki değişiklikler Hizmetin işleyişini etkileyebilir; bu tür değişikliklerden sorumlu değiliz.

5. Ücretler ve Ödeme

  • Seçtiğiniz pakete ait ücretler, abonelik döneminde geçerli fiyatlandırmaya göre tahsil edilir.
  • Fiyatlar üzerinde değişiklik yapma hakkımız saklıdır; mevcut dönem için değişiklik uygulanmaz.
  • Aksi belirtilmedikçe ödenen ücretler iade edilmez.
  • Aboneliğinizi istediğiniz zaman iptal edebilirsiniz; iptal, dönem sonunda yürürlüğe girer.

6. Yapay Zeka Çıktıları

Hizmet yapay zeka tarafından otomatik içerik üretir. Üretilen yanıtların doğruluğu, uygunluğu ve mevzuata uygunluğu konusunda nihai sorumluluk, Hizmeti yapılandıran ve kullanan işletmeye aittir. Yapay zekanın hatalı, eksik veya beklenmeyen çıktılar üretebileceğini kabul edersiniz ve kritik süreçlerde insan denetimi önerilir.

7. Fikri Mülkiyet

Hizmet, yazılım, tasarım ve markalar dahil tüm fikri mülkiyet hakları By Shiva Dış Ticaret'e aittir. Size yalnızca Hizmeti bu Koşullar kapsamında kullanma hakkı tanınır; bunun dışında herhangi bir hak devri yapılmaz.

8. Sorumluluğun Sınırlandırılması

Hizmet "olduğu gibi" sunulur. Yürürlükteki yasaların izin verdiği azami ölçüde; dolaylı, arızi veya sonuç niteliğindeki zararlardan (kâr kaybı, veri kaybı, iş kesintisi vb.) sorumlu değiliz. Toplam sorumluluğumuz, ilgili talebin doğduğu tarihten önceki 12 ay içinde Hizmet için ödediğiniz tutarla sınırlıdır.

9. Fesih

Bu Koşulları ihlal etmeniz halinde hesabınızı askıya alabilir veya sonlandırabiliriz. Siz de aboneliğinizi dilediğiniz zaman sonlandırabilirsiniz. Fesih sonrası verilerin silinmesi için Veri Silme Talimatı sayfasına bakınız.

10. Değişiklikler

Bu Koşulları zaman zaman güncelleyebiliriz. Güncel sürüm bu sayfada yayımlanır ve "Son güncelleme" tarihi revize edilir. Değişiklik sonrası Hizmeti kullanmaya devam etmeniz güncel Koşulları kabul ettiğiniz anlamına gelir.

11. Uygulanacak Hukuk

Bu Koşullar Türkiye Cumhuriyeti yasalarına tabidir ve doğabilecek uyuşmazlıklarda Türkiye mahkemeleri ve icra daireleri yetkilidir.

These Terms of Service ("Terms") govern your use of Digimoli Pro Sales ("Service"), provided by By Shiva Dış Ticaret. By registering for or using the Service, you agree to these Terms.

1. Description of the Service

Digimoli Pro Sales is a cloud-based software service (SaaS) that replies with AI to messages and comments from Meta (Instagram & Facebook) and other supported platforms, collects customer information, and runs order/payment processes through integrated e-commerce systems.

2. Eligibility & Account

  • You must be at least 18 years old and authorized to enter into a contract on behalf of your business.
  • You are responsible for keeping your account credentials confidential and for all activity under your account.
  • You agree that the information you provide is accurate and up to date.

3. Acceptable Use

When using the Service, you agree not to:

  • Violate applicable laws, the Meta Platform Policies or any third-party platform rules,
  • Send spam, deceptive, fraudulent or unsolicited messages,
  • Market illegal, harmful or prohibited products/services,
  • Reverse engineer, misuse or compromise the security of the Service,
  • Process the data of third parties without their knowledge or consent.

4. Third-Party Platforms

The Service relies on the APIs of third-party platforms such as Meta and Shopify. You are responsible for complying with those platforms' terms. Changes in their own policies may affect how the Service works; we are not responsible for such changes.

5. Fees & Payment

  • Fees for your chosen plan are charged according to the pricing in effect for your subscription period.
  • We reserve the right to change prices; changes do not apply to the current period.
  • Unless stated otherwise, fees paid are non-refundable.
  • You may cancel your subscription at any time; cancellation takes effect at the end of the period.

6. AI Output

The Service generates automated content via artificial intelligence. Final responsibility for the accuracy, appropriateness and legal compliance of generated responses rests with the business that configures and uses the Service. You acknowledge that the AI may produce incorrect, incomplete or unexpected output, and human oversight is recommended for critical processes.

7. Intellectual Property

All intellectual property rights in the Service, including software, design and trademarks, belong to By Shiva Dış Ticaret. You are granted only the right to use the Service under these Terms; no other rights are transferred.

8. Limitation of Liability

The Service is provided "as is". To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages (lost profits, data loss, business interruption, etc.). Our total liability is limited to the amount you paid for the Service in the 12 months preceding the relevant claim.

9. Termination

We may suspend or terminate your account if you breach these Terms. You may also terminate your subscription at any time. For deletion of data after termination, see the Data Deletion Instructions page.

10. Changes

We may update these Terms from time to time. The current version is published on this page and the "Last updated" date is revised. Continuing to use the Service after changes means you accept the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of Türkiye, and the courts and enforcement offices of Türkiye have jurisdiction over any disputes.
